1. OPERATIVE SCOPE OF THE ONLINE SHOP

The Products which are marketed by BECKER IBERICA DE BOMBAS DE VACIO Y COMPRESORES, S.A. with Spanish Tax number (C.I.F.) A-82860214 and registered office at C/ Masía Nova, 3-5-, Nave E- (Santa Magdalena Industrial Estate) 08800 Vilanova I La Geltrú (Barcelona) (hereinafter, BECKER IBERICA, S.A.) through its Online Store hosted on its own website, are the parts and spare parts included in its said Online Store´s catalog. These parts and replacements are intended for being used in equipment that our company markets for exclusive professional, business, industrial or semi-industrial use, therefore not being suitable for domestic use.

Having our Clients (whether individuals or legal entities) the legal status of “entrepreneurs” as defined in Article 4 of Royal Legislative Decree 1/2007, which approved the consolidated text of the Law General for the Defense of Consumers and Users (hereinafter referred as “the General Law for the Defense of the Consumers”), the purchases of Products made in the Online Shop of this website are not subject to the General Law for the Defense of the Consumers and Users. Purchases and the guarantee of the products acquired on this website are governed by the rules of the Spanish Commercial Code and these General Purchase Conditions.

BECKER IBERICA S.A. only makes deliveries of the products offered in the Online Store of our website to postal addresses in the peninsular territory of Spain and the Balearic Islands.

For shipments to the Canary Islands, Ceuta or Melilla, check with us directly (comercial@becker-iberica.com) for availability and cost.

Purchase transactions carried out in our Online Shop may be processed in the following languages: Spanish and English.

2. TERMS OF THE ONLINE PURCHASE

These General Terms of Purchase - hereinafter GTP -, as well as any other particular term that may eventually apply (in which case it will be duly displayed on the screens of the online purchase process), governs the online purchase of the Products that BECKER IBERICA, SA markets in its Online Shop catalog.

The GTP are binding for both parties, BECKER IBERICA, S.A. and the Client who makes the online purchase, forming an integral and inseparable part of the Purchase Agreement that will be executed upon confirmation of the Client´s purchase order, through the contracting procedure specified in the Section 3.

BECKER IBERICA, S.A .reserves the right to modify these GTC at any time.

The modifications made to the CGC will not come into force for new transactions as long as they are not accepted by the Client for each new Order placed according to the procedure established for this purpose in Section 3 ONLINE PURCHASE PROCEDURE.

3. ONLINE PURCHASE PROCEDURE

The online Acquisition of Products can only be done by persons of legal capacity over eighteen (18) years old, who has previously registered in our web site(*). In each purchase transaction the Client must follow the following steps and instructions that will accompany the entire online shopping interactive process:

  1. Selection in our online catalog of the Product that you want to purchase online.
  2. Place the selected Product in the Shopping Cart (new Products can be added to your Shopping Cart, or tick "BUY" to proceed with the purchase process of the selected Products to be purchased online).
  3. Filling in the PURCHASE ORDER FORM which will be immediately displayed on-screen, in which the Client must enter the delivery address, invoice data, type of delivery, payment method, and email address to receive the purchase invoice.
    The Client warrants the accuracy of all the information provided in the PURCHASE ORDER FORM. Should all or part of the delivery addresses prove incorrect, thereby obliging BECKER IBERICA, S.A. to return the Order to its warehouse, BECKER IBERICA, S.A. shall be entitled to charge the Client the related-administrative and return shipping costs of such Order.
  4. On-screen display of the Order Summary with the delivery terms and shipping costs.
  5. Validation and CONFIRMATION OF THE ORDER and acceptance of these GTP by ticking the acceptance box, which shall imply the reading, understanding and irrevocable acceptance of each and every one of its provisions, as well as, where appropriate, of the particular terms, being deemed as granted from that moment the Client´s consent for the validity and execution of the purchase contract binding for both parties: the Client as buyer and BECKER IBERICA,S.A. as seller.
  6. Payment in accordance with the electronic means of payment enabled (see below Section 7 "PAYMENT and INVOICE") on the corresponding screen, or by bank transfer payment within 24 hours after the CONFIRMATION OF THE ORDER.
  7. Immediate receipt of an email from BECKER IBERICA, S.A. in the account used by the Client upon registration as soon as possible and no later than 24 hours following the CONFIRMATION OF THE ORDER, or where appropriate, within the 24 hours following the receipt of the bank transfer, of the Order acceptance together with the following information of the purchase transaction:
    1. Order number
    2. purchase date
    3. reference of the purchased Product
    4. price
    5. form and shipping costs, and
    6. estimated delivery date, which will not exceed the maximum period of 30 days.


(*) Registration at https://becker-iberica.com is free of charge. The purpose of the registration is for carrying out the products shipment, their invoicing and to offer you the best offers. You have no obligation to be registered and you can unsubscribe at any time. Clients wishing to register, will be assigned personal credentials composed of a unique identifier (which will be the email address) and a password whose custody and custody will depend exclusively on the user, who must operate with them with due diligence. Therefore, you will not use other keys other than yours.

4. PRODUCT AND STOCK AVAILABILITY

The catalog of Products offered in our Online Shop shows the most up-to-date information and description of Products. However, the photos, description and information shown in the online catalog are provided just for guidance, so they might not exactly match those of the model offered, and the model may vary depending on the technical specifications required by the Client.

BECKER IBERICA, S.A. will try to keep the information of the specifications of each product as up-to-date as possible.

The catalog itself, and especially the offer of the products in our Online Shop, is not to be deemed itself as a binding offer for the sale of the products.

The stock available for sale in our Online Shop is kept updated. BECKER IBERICA, S.A. will make its best efforts to avoid delays due to lack of stock or supply delays from its suppliers.

If, upon execution of the purchase transaction, it turns out that for reasons beyond BECKER IBERICA, S.A., the product is not available for being timely delivered to the Client, BECKER IBERICA, S.A. will email the Client the Order cancellation in a maximum term of 5 days, with the immediate refund to the Client of the price paid upon placing the online Order.

5. PRECIOS

Prices of the Products offered in our Online Shop are quoted in Euros (VAT not included). Delivery charges are not included in the prices quoted.

Certain products of our Online Shop may require assembly or specialized installation in the equipment to which they are intended. Such assembly and/or installation operations are not included in the price of the Products. Should be the Client interested in hiring such services from us, please contact us at info@becker-iberica.com.

Prices of the Products are subject to change at any time. To guarantee the Client the full certainty and security of the Products prices, the price applicable to the Product purchased online will be that one shown on our website at the time of validating the purchase Order, according to the procedure described in Section 3. "ONLINE PURCHASE PROCEDURE".

6. DELIVERY COST

The shipping costs will be calculated separately on the basis of the items weight and the resulting amount will be indicated in the purchase procedure described under Section 3 “ONLINE PURCHASE PROCEDURE” before being completed by the Client by ticking the box of CONFIRMATION OF THE ORDER.

The shipping costs will be duly broken down in the purchase invoice.

7. PAYMENT AND INVOICE

The Client agrees to pay the total amount of the purchase at the time of ticking the CONFIRMATION OF THE ORDER -as provided for in Section 3 “ONLINE PURCHASE PROCEDURE”-, or within 24 hours after the transfer bank, when this has been the payment method choice. The price of each Product will be added with the VAT and the shipping costs, and if applicable, which will be shown broken down as well as the final total amount before formalizing the CONFIRMATION OF THE ORDER and prior to the payment with which the purchase procedure is completed.

The Client authorizes us to email the invoice of the purchase of the products to the Client´s email address provided to us upon registration or any other of the Client´s choice as provided in the PURCHASE ORDER FORM. Should the Client require the invoice in paper format, the Client may request it so by sending us an the email to comercial@becker-iberica.com

8. SHIPMENT: TIME AND PLACE OF DELIVERIES

The delivery time of each Order which will depend on the stock availability, will be reported to the Client in the email sent by BECKER IBERICA, S.A. with the Order acceptance, in accordance with the provisions of letter vii) Section 3 “PROCEDURE FOR PURCHASE”.

BECKER IBERICA, S.A. carries out the shipments of products to Clients through a courier company contracted for this purpose.

The delivery times provided to us by the courier company is an estimate and it may vary for logistical reasons or due to force majeure, so it will not be binding, without prejudice to BECKER IBERICA.S.A. will make its best efforts to meet these estimated deadlines and delivery times.

The delivery is considered made from the moment in which the courier company makes the product available to the Client, at which time the risks will be transferred to the Client. The time of making available to the Client will be fixed through the control system used by said courier company.

BECKER IBERICA, S.A. will inform the Client of any delivery delay as soon as it becomes aware of it and will not be responsible in any case for the breach of the deadlines and delivery dates communicated to the Client (in particular and without limitation, of any delay that occurs in the delivery by causes that are beyond BECKER IBERICA, S.A. control). When the delay is attributable to BECKER IBERICA, S.A., the Client may cancel his Order in accordance with the procedure described in Section 9 "RETURN AND REFUND". Delivery will not be considered a delay in those cases in which the Order has been made available to the Client by the courier company within the agreed period and could not be delivered due to causes attributable to the Client.

We do not send Orders to post office boxes, nor will we accept orders in which it is not possible to clearly identify the recipient of the order and the delivery address.

9.  ETURN AND REFUND

All products purchased from BECKER IBERICA, S.A. may be returned and refunded, and as long as the nature of the acquired good allows it. provided that the Client:

  1. informs in writing to BECKER IBERICA, S.A. of his intention to return the purchased product(s) within a maximum period of 14 calendar days from the delivery date;
  2. bears the return shipping costs of the product to BECKER IBERICA, S.A. offices, and
  3. the  ollowing conditions are also met:
    1. The Product has not been used or unsealed and it keeps the same condition in which it was delivered, and retains its original packaging and labeling.
    2. The shipment must be made using the same box in which it has been received to protect the Product. For the case that can not be done with the box with which it was delivered, the Client must return it in a appropriate box to ensure that the Product reaches BECKER IBERICA,S.A. warehouse with the maximum possible guarantees.
    3. A copy of the delivery note must be included in the package, where the returned Products and the return reason is also marked.


The return of the Product (s) will result in a refund right for he Client equal to the returned Product cost minus the return shipping service cost.

Nevertheless, in cases where the delivered Product is defective, incorrect or not suitable for use for which it has been manufactured, in which case BECKER IBERICA, S.A. will borne the shipping return costs indicated in the transportation invoice. Such returns will be managed in accordance with the treatment provided for the cases governed by Section 10 “WARRANTY”

10 . WARRANTY

  1. The external or visible defects of the Products or non-conformities of the delivery with the Order must be notified, in writing, within a maximum period of 4 calendar days from the date of delivery.

    In case of mistakes in the delivery of the Products, the delivery of a new sample of the purchased Product, free of hipping costs, will be the only right that the Client will hold without being able to claim from BECKER IBERICA, S.A any other compensation.

  2. 2. BECKER IBERICA, S.A. guarantees that the Products will conform to the description of the Order or any other communication sent by the Company, including the invoice and instructions of the Product and subject to tolerances and variations that are in accordance with commercial uses and industrial practices in terms of dimensions, tolerances and variations consistent with the methods of verification and inspection used in practice.

    If the Products present a manufacturing defect or lack of conformity, the Client will be entitled to request compliance with the sale contract without any cost. In such cases, BECKER IBERICA, S.A will decide whether to replace the Products or to repair them.

    The term of the guarantee due to manufacturing defect or lack of conformity of the Product shall be twelve (12) months from the date of delivery for all claims communicated within said period and based on the non-conformity of the Products.

    Small variations, common in trade, quality, color, weight, processing and components, will not be considered defects or defects in the purchase Products, nor will they give the Client the right to demand compensation for damages and / or damages.

    The warranty will not apply to damages that are the consequence of an accident, or an improper o mistaken use, manipulation, installation, processing or treatment, of the Products. In this way, and as an example, BECKER IBERICA, S.A. shall not be liable for the following: improper or incorrect use and / or failure to follow the instructions included in the instruction book  r documentation provided by the manufacturer, incorrect assembly by the Client or a third party, normal wear and tear, improper or negligent handling, use of improper  aterial of operation or substitute material.

    BECKER IBERICA, S.A. reserves the right to exclude from this warranty coverage he Products considered as consumables subject to wear and tear due to its normal use.


11. LIMITATION OF LIABLILITY

The Client bears the liability for a correct use, assembly and due maintenance of the purchased Products, as well as being technically qualified to use them.

BECKER IBERICA, S.A. will not be responsible in any case in the following circumstances:

  1. Errors or delays in the Client´s access to the website  hen entering his data in the PURCHASE ORDER FORM, the slowness or impossibility of reception by the recipients of the ORDER CONFIRMATION or any anomaly that may arise when these incidents are due to problems in the Internet network, due to fortuitous causes or force majeure and any other unforeseeable contingency beyond BECKER IBERICA, SA .
  2. Failures or incidents that may occur in communications, deletion or incomplete communications, so that it is not guaranteed that the services of the website are always operational.
  3. Errors or damages produced to the website due to inefficient or bad faith use by Clients and/or Users.
  4. Non-operation or problems in the email address provided by the Client to send the Order acceptance.


In any case, BECKER IBERICA, S.A. is committed to solve any problems that may arise and to offer its best endeavors o reach a quick and satisfactory solution of the incident.

12. APPLICABLE LAW AND VENUE

These General Conditions are governed by Spanish law. 

The resolution of conflicts or disputes will be solved by the Courts and Tribunals of Barcelona, ​​ being expressly aived any other competent jurisdiction.
